Terms & Conditions
All Patrons must abide by the general Terms and Conditions of entry. Please familiarise yourself with the following information and feel free to discuss these terms with our friendly team members if you require advice, guidance and/or clarification.
These Terms and Conditions will apply until further notice.
1. Introduction
The following are the Terms and Conditions on which Donald Swimming (referred to as we, us, and our) offers membership at our facilities to a student (referred to as the student) nominated by you (referred to as you, your).
You must be over the age of 18 years to enter into this agreement. You may nominate a student under the age of 18 years, to whom you are the parent/guardian. You are thereby agreeing that you are bound by these terms and conditions personally, on their behalf.
2. Swimming Lessons and Squad Programs
Swimming lessons and squad programs are conducted each week of the year. Excluding Public Holidays and the annual closure at Christmas. Details of dates on which lessons will be held is available at the kiosk.
At enrolment, the student will be allocated a class day and time depending on availability and the student’s swimming competency.
We will strive to ensure class and teacher consistency; at times this is not possible due to unavoidable circumstances.
3. Safe Swim Check and Assessments
An assessment may be booked for new enrolments in order for the student to be place in the most suitable class.
Once a student is enrolled in our program, assessments are ongoing. The Swim School Coordinator will be responsible for the promotion of swimmers through the levels.
4. Appropriate clothing
Appropriate swimwear is to be worn at all times.
All children not toilet trained MUST wear a disposable or waterproof swimming nappy.
Parents and guardians assisting within Babies Program must wear a T-shirt while participating in the class.
5. Inclusion
All patrons are required to make Donald Swimming a positive environment to be in by adhering to the following:
1. Inclusion of every person regardless of race, age, culture, religion, gender, ability level, sexual orientation.
2. Showing respect at all times to both staff and clients.
3. Violence and abusive behaviour will not be tolerated. This may include intimidation and harassment.
We reserve the right to refuse entry or participation in lessons to any person who attends Donald Swimming and do not adhere to our Discrimination Policy.
6. Payment of Fees
At the conclusion of each month, Donald Swimming will automatically generate the next month’s fees. For customers not on Direct Debit, the first week of each month will be "Payment Week". If lessons are not paid by the end of the second week of the month, swimmers with fees that are outstanding will have their classes/bookings cancelled and will not be able to participate until all outstanding fees are paid and up to date. If a student's class is cancelled as a result of outstanding fees, their class spot will become available for new bookings.
We may vary membership fees by providing you with 30 days written notice.
Payment Option 1: Direct Debit
Student fees may be paid by direct debit from your nominated bank account or credit card (VISA or Mastercard only). Direct debits will be processed on a Wednesday (or if a debit falls on a non-business day, the next business day) in advance for the following fortnight. Debits are perpetual and will continue until you submit a Cancellation Form.
Student fees will be debited whether or not the student attends lessons.
Your direct debit arrangement is set up with our third party – Ezidebit. Terms and conditions and fees associated with the direct debit are stated on the Ezidebit Service Agreement.
If your payment is unsuccessful and payment is not received, management reserves the right to restrict the student’s access to the facility until arrears are cleared.
In the event overdue accounts are referred to a collection agency you will be held liable for all costs incurred, including legal demand costs.
Payment Option 2: Paid in advance – monthly
Student fees may be paid over the counter by cash or credit card (VISA or Mastercard) on the first lesson of the Month.
Families with multiple students are eligible for a discount.

7. Refunds and Transfers
Donald Swimming abide by the Consumer Law offering customers refunds and exchanges on any faulty products purchased through the Swim School Kiosk.
Learn to Swim and Squad lessons are not transferrable to other students.
8. Make Up Policy
All make up lessons are free of additional charges but are subject to the following:
If we can cancel a lesson due to unforeseen circumstances, we will issue you a make up lesson.
If you cancel a lesson, by notifying Donald Swimming at least one hour prior to the commencement of the scheduled class, you will be eligible for a make up lesson. Donald Swimming will use discretion in the case of an emergency.
Students who do not attend their lesson without notice will not be eligible for a make up lesson.
Make up lessons can only be booked a maximum of 14 days in advance.
Students must be enrolled and a financial member to use make up lessons.
Unused make up lessons will be forfeited upon cancellation of enrolment.
In School Swimming (Physical Education) lessons do not apply as enrolment.
Make up lessons cannot be exchanged for refunds, for use of holiday programs or credit towards students’ fees.
Make up lessons are non-transferable.
Failure to attend a scheduled make up lesson will result in the class being forfeited.
9. Suspension of Lessons
You may suspend future lessons and direct debit due to an illness or injury sustained by the student for the period of the illness or injury.
To request a suspension, you must complete a Suspension form and submit to reception, attached with a medical certificate from a medical practitioner stating the students name and dates of the illness or injury.
Membership and Direct Debit arrangements will recommence on the return date specified on the request form.
Verbal requests of suspension will not be accepted.
10. Cancelling Lessons
We offer a 7 day cooling off period from the date of joining. You may cancel the student’s membership immediately by written notification.
You may cancel the student’s membership at any time by giving us 14 days notice in writing (Cancellation Form available from kiosk).
All outstanding fees must be paid upon cancelling your membership.
We may cancel the membership with 28 days notice, or at any time if you or the student fail to comply with these terms and conditions or the conditions of entry displayed at the facility.
Any unused makeup lesson's or credits not used by your last regular lesson or cancelation date will automatically be forfeited.
11. Your Details
It is your responsibility to inform us of any change in contact and banking details. Forms are available at the kiosk.
In accordance with our Privacy Policy, we are only able to discuss students details with the nominated parents/guardians.
12. Photography
If you wish to operate visual recording equipment within the facility you must speak to a Donald Swimming team member prior to recording. We ask that you respect the wishes of other patrons who may not wish to have themselves or their children filmed whilst at our facility.
When taking photographs, you must capture your child only and not include other children in the class to respect the privacy of other families.
No mobile phones/photography or video recording is permitted in or near the change rooms.
13. Public Holidays and Pool Closures
Donald Swimming is closed for all Public Holidays. Members are not charged for these dates as classes are not operational.
In the event of an unforeseen incident which could affect the health and safety of our patrons we reserve the right to close the pool. Donald Swimming will, where possible, attempt to contact affected swimmers via email, SMS regarding closure.
If lessons are cancelled in the interest of the health and safety and welfare of Donald Swimming staff and members or under the directive of a government authority, clients will be eligible to make up lessons.
Refunds will not be given for any lesson missed as a result of the closure.
14. Parental Supervision
Students in our Babies Program require a parent or guardian over the age of 18 years in the pool during lessons. Instructors are not able to accept students into these classes without a parent in attendance in the water.
Students in the Learn to Swim and Squad Programs must be dropped off to the instructor/coach and collected from the team member by a parent or guardian at the start and conclusion of the lesson. Students are not permitted to enter the pool prior to the instructor/coach beginning their scheduled lesson.
All patrons must abide by the general terms and conditions of Donald Swimming. Management reserves the right to refuse entry, suspend or cancel lessons without a refund or request any person to leave the premises if that person is failing to adhere to the above conditions or if deemed necessary.
